In the present case, the petitioner has raised a grievance that he has not been paid salary since December, 2009. As per record the petitioner was appointed as Assistant on 21.8.1976 and was transferred vide Memo No. 04 MU dated 29.6.2009 from the Office of the Circle Officer, Suryagarha to the Block Office, Suryagarha. From there he was relieved vide letter 21.07.2009, accordingly he gave his joining, was accepted by the Controlling Officer and accordingly information was also given by the office. He has further said that the Petitioner was given the
Patna High Court CWJC No.12979 of 2010 dt.18-04-2018 additional charge of In-charge Head Clerk in the office of the CDPO from there he was transferred to the District Revenue Section from District Supply Office. The Claim has been made by the Petitioner that he has acted as per the direction of the Respondent but he has been deprived of salary from 2009. In such view of the matter, Petitioner is directed to file representation to the Collector, Lakhisarai who will consider the representation of the petitioner and take decision in accordance with law and if it is found that petitioner is entitled the same should paid to him within a period of three months from the date of filing of the representation.
With the aforesaid observations and direction this writ petition is disposed off.
