JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) and 30(d) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.03.2022, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 25 litres of liquor from a room which was without door in which straw was kept and is alleged to be the house of the petitioner.

Learned counsel for the petitioner submits that the house is a joint family property and as such he was not knowing who had kept the liquor in the house, further the recovery was

No.24602 of 2022(2) dt.20-05-2022 2/2 from a room which had no door as such it appears that some unknown person with a view to conceal the liquor had kept the same without knowledge of the petitioner Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 08.03.2022, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Pali P.S. Case No. 26 of 2022.
