31-08-2016 Heard Sri Sanjay Kumar, learned counsel for the petitioner and Sri Gopesh Kumar, learned Addl. Public Prosecutor. The sole petitioner, apprehending her arrest in Madanpur P.S. Case No. 87 of 2016 registered for the offence under Sections 188, 353, 341, 323, 324, 325, 326, 332, 333, 307, 447, 504, 506/34 of the Indian Penal Code, has prayed for grant of bail in the event of her arrest.

It was submitted by learned counsel for the petitioner that petitioner is an old lady and petitioner with her three daughters have been made accused in the present case falsely and maliciously. It was submitted by learned counsel for the petitioner that on an allegation that while the Circle Officer, who is informant of the present case, alongwith police force had arrived

Patna High Court Cr.Misc. No.32018 of 2016 (3) dt.31-08-2016 2/2 for removing encroachment, the petitioner with her three daughters committed offences, as alleged in the F.I.R. Learned counsel for the petitioner submits that all the three daughters of the petitioner were arrested on the date of occurrence itself. Keeping in view the fact that petitioner is lady and nature of accusation, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Girija Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 87 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) Anay U T
