====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 03-05-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

Learned counsel submits that this is the second attempt of the petitioner to seek bail, it is further submitted that earlier the bail application of the petitioner was rejected by order dated 04.01.2023 in Cr. Misc. No. 54050 of 2022 with a liberty to the petitioner to renew his prayer for bail after framing of charge. Learned counsel submits that the charges against the petitioner stands framed by order dated 16.02.2023 as would be evident from Annexure-2 to the bail application.

Patna High Court CR. MISC. No.24752 of 2023(2) dt.03-05-2023 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bajpatti P.S. Case No. 246 of 2021.

One of the bailors of the petitioner shall be father of the petitioner Purshottam Ray @ Purshottam Yadav. Further, in the event, if the learned Trial Court comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned Trial Court shall forthwith cancel his bail bonds after recording reasons.
