Petitioner is apprehending his arrest in connection with Ara Town P.S. Case No. 219 of 2017 registered for the offences punishable under Sections 25(1-b)a, 26,35 of the Arms Act.

Counsel for the petitioner submits that the recovery of arms and live cartridges, as alleged in the F.I.R., is from the possession of one Mahendra Kumar. He further submits that merely on the confessional statement of the said Mahendra Kumar, the petitioner has been made accused in the case even though no recovery has been made from the possession of the petitioner.

Let the above named petitioner, in the event of his arrest or surrender within four weeks from today, shall be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara, in connection with Ara Town P.S. Case No. 219 of 2017, subject to all conditions as laid down in Section 438(2) of Criminal Procedure Code.
