2. In this case, the petitioner is seeking regular bail in connection with Govindganj (Malahi) P.S. Case No. 689 of 2023, registered for the offences punishable under Section 376 of the Indian Penal Code and Sections 4, 6 of the POCSO Act.

3. As per allegation, the petitioner committed rape upon the victim and she became pregnant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. When the petitioner asked DNA test of the baby, on the next day, the baby died. The petitioner is under custody

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail and submitted that the informant is a minor girl and she fully corroborates the allegation in her statement under Section 164 of the Cr.P.C. Earlier also, a case of kidnapping was lodged against the petitioner as Paharpur P.S. Case No. 210 of 2017.

6. Considering the above-mentioned facts and circumstances, the petitioner does not deserve the privilege for bail, which is hereby rejected.
