2. The petitioner has preferred this application for grant of regular bail in connection with Raghubansh Nagar P.S. Case No. 47 of 2024 registered for the offences punishable under Section 105 of the B.N.S. 2023.

3. As per the prosecution story, the informant has alleged that on 21.08.2024 his son was suffering from fever and he called a doctor (petitioner) for the treatment of his son. The doctor measured the temperature of his son and told that he needs an injection as his body temperature is too high. Thereafter, he injected 1gm of Monocef due to which his child got unconscious and resultantly, he died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is previous dispute between the parties. There is no

No.23355 of 2025(2) dt.28-04-2025 2/2 any eye witness of the alleged occurrence and none of the prosecution witnesses have supported the version of the informant and the entire allegations against the petitioner are false and concocted. Petitioner has no concern with the alleged occurrence. Learned counsel further submits that both the parties are next door neighbour and recently, the matter has been amicably settled between them. In support of this fact he has filed compromise petition which is duly signed by both the parties. The antecedent of the petitioner is clean and he is in custody since 28.01.2025.

5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Keeping in view the aforesaid facts and considering the period under custody, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Purnea in connection with Raghubansh Nagar P.S. Case No. 47 of 2024.
