2. Petitioner seeks regular bail in connection with S.T. Case No. 13 of 2025 arising out of Alamnagar P. S. Case No. 268/2024 in a case registered for the offences punishable under Sections 103(1), 61(2) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

3. As per the prosecution case, all the F.I.R. named accused persons including this petitioner are alleged to have conspired and got husband of the informant killed by some unknown miscreants.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired

Patna High Court CR. MISC. No.25982 of 2025(2) dt.27-06-2025 2/2 only on the basis of tower location. Save and except the tower location, there is no other material to record to show complicity of the petitioner in the alleged incident. None of the witnesses have claimed to have seen this petitioner either committing the crime or near the place of occurrence. Moreover, similarly situated co-accused, namely, Kiran Devi has already been granted anticipatory bail by this Court vide order dated 03.03.2025 passed in Cr. Misc. No. 7326 of 2025. Petitioner is in custody since 02.08.2024.

5. Learned counsel for the informant vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV, Madhepura in connection with S.T. Case No. 13 of 2025 arising out of Alamnagar P. S. Case No. 268/2024. (Prabhat Kumar Singh, J) Navya/- U T
