ANJANA MISHRA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 06.03.2019 in connection with Paroo P.S. Case No.70 of 2019 registered for the offence under Sections 270, 272, 328, 467, 468, 471, 419, 420 120B and 34 of the Indian Penal Code and Section 4/6 of the Trade Mark Act and Section 30, 30A, 35C, 36 & 38 of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that though the alleged recoveries were made from one Hari Rai, he has attributed that this item was belonging to the petitioner and therefore, petitioner has been taken into custody. He further submits that the name of the petitioner has surfaced in confessional statement made before the police by the said Hari Rai. Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Paroo P.S.
