JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-12-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks regular bail in connection with Rajapakar P.S. Case No. 19/2018 pending in the court of learned Additional Chief Judicial Magistrate-VII, Vaishali at Hajipur, registered for the offence punishable under Sections 304B, 328/34 of the Indian Penal Code.

Allegation against the petitioner including the accused persons is of torturing upon the victim due to nonfulfillment of demand of dowry. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The petitioner is in jail custody since 10.12.2018. The petitioner has no criminal antecedent.

Patna High Court CR. MISC. No.26395 of 2020(3) dt.01-12-2020 2/2 Learned APP for the State opposes the prayer for bail petition.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.

Accordingly, this application is dismissed.

However, the trial court is directed to conclude the trial as early as possible.
