ANJANA MISHRA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.01.2019 in connection with Complaint Case No.9 C2 of 2019 (Excise Act No.76 of 2019) registered for the offence under Section 30 (a) of the Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner and he has been falsely implicated in connection with the present case. It is further submitted that petitioner has no criminal antecedent.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.24929 of 2019(2) dt.17-04-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sri Dharamsheel Srivastav, learned Additional Sessions Judge-II-cum-Special Judge (Excise Act), Begusarai, in connection with Complaint Case No.9 C2 of 2019 (Excise Act No.76 of 2019).
