Since the physical court proceeding is non-functional, due to present pandemic COVID-19, the matter is listed with defects.

Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of physical court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner seeks bail in a case registered for the offence punishable under Section 353 of the Indian Penal Code and Section 37(2) of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner (Ranjit Kumar) along

No.24537 of 2020(2) dt.23-09-2020 2/2 with two others is that they came at police station and asked about the land dispute in which, it was said that a proceeding under Section 107 Cr.P.C. was earlier started and other question will be asked from SHO. Thereafter, petitioner was making hulla and found that he was taking wine. He was medically examined and found he was drinking wine.

Learned counsel for the petitioner submits that petitioner is languishing in judicial custody since 20.02.2020. He further submits that petitioner went at police station for asking action against the land dispute and he tried to take picture by his mobile to the action of the police and due to that he was arrested by the police in this false case. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Atri Police Station Case No. 43 of 2020.
