The petitioners, namely, Madan Mohan Singh and Rani Singh, apprehend their arrest in a case under Section 302 and other sections of the Indian Penal Code and Sections 3 / 4 of the D.P. Act.
The father of Priti Kumari stated that his daughter was married on 19.06.2005 with Ranjit Singh, son of the petitioners. His daughter disclosed that her husband and other inlaws were demanding dowry. Somebody informed him on 19.05.2014 that his daughter was missing. The informant came and did not find his daughter in the house. Patna High Court Cr.Misc. No.27947 of 2015 (4) dt.09-10-2015 2/3 mother-in-law of Priti Kumari. One skeleton was found which was identified by the brother of Priti Kumari to be of Priti Kumari but, later on, the same could not be identified as the dead body of Priti Kumari. Ranjit Kumar, husband of Priti Kumari, had filed a complaint case, being Complaint Case No. 1018/2014, against Sudhir Kumar Singh and others for kidnapping of his wife Priti Kumari. On the basis of the complaint case filed by the husband of the deceased, Govindganj P.S. Case No. 124/2014 was registered. Learned counsel for the petitioners submits that the petitioner no. 1 had his work in Steel Authority of India Ltd., Burnpur (West Bengal) and petitioner no. 2 is the wife of petitioner no. 1.
The marriage was solemnized in the year 2005 and, after nine years, this case has been registered. During the period of nine years, neither the informant nor his daughter Priti Kumar made any complain about ill-treatment due to nonfulfillment of demand of dowry. Priti Kumar got two children and they are living with the petitioners.
Considering the facts aforesaid and the fact that the petitioners are father-in-law and mother-in-law of Priti Kumari (the deceased) and no specific allegation is made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period
Patna High Court Cr.Misc. No.27947 of 2015 (4) dt.09-10-2015 3/3 of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sadar, Motihari in Govindganj P.S. Case No. 72/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
