The petitioner is apprehending his arrest in connection with Bihar P.S.Case No.382 of 2017 registered for offences punishable under Sections 414 of the Indian Penal Code.

Allegation against the petitioner is of recovery of stolen motorcycle.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in case as the informant had went to the chicken shop and even according to his evidence, he had sold the same to the petitioner but the same was recovered from in front of the house of the shop-keeper.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that a large number of cases i.e. 9

Patna High Court Cr.Misc. No.13197 of 2018 (2) dt.04-04-2018 2/2 cases are pending.

Having heard both sides and in view of the facts and circumstances, as stated above, and in view of criminal antecedent and the nature of the allegation, this is not a case for grant of bail rather let the petitioner surrender and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
