The petitioner seeks bail in anticipation of his arrest in connection with Mufassil P.S. Case No. 452 of 2019, dated 09.10.2019, instituted for the offences under Sections 147, 148, 323 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner and several others are said to have
Patna High Court CR. MISC. No.26413 of 2020(2) dt.21-10-2020 2/3 assaulted the informant. The cause of the occurrence is stated to be a minor accident between two motorcycles. The act of firing has been attributed to one Rishi Paswan, but there is no firearm injury on any person and no cartridge also appears to have been recovered.
A similarly situated accused person, viz., Amarjeet Kumar has been granted anticipatory bail by a Bench of this Court, which fact has been stated in paragraph 11 of the bail application.
There is only one injury on the head of the informant about which the opinion is reserved. The aforesaid injury does not appear to have been specifically attributed to the petitioner.
Regard being had to the aforesaid facts and the petitioner being a person of clean antecedents, he, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief
