1. Heard learned counsel for the petitioner and learned Special P.P. for the Vigilance Mr. Arvind Kumar.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 417, 419, 420, 467, 468, 471, 120B of the Indian Penal Code.

3. Learned counsel for the petitioner submits that in sum and substance the allegation against the petitioner is that he obtained appointment as teacher, based on forged two years teachers training certificate, obtained from Assam.

4. Learned counsel appearing on behalf of the petitioner straightaway draws the attention of the Court to supplementary counter affidavit filed on behalf of the Vigilance.

No.26816 of 2025(3) dt.13-08-2025 2/3 It is submitted that from perusal of the pleadings made in the supplementary counter affidavit filed on behalf of the Vigilance, it would manifest that based on the opinion of the learned Law Officer, Vigilance, two years teachers training certificate was sent for verification to Assam and after verification, it was found that the certificate is genuine. It is next submitted that after filing of the supplementary counter affidavit, the Vigilance filed a second supplementary counter affidavit, wherein a plea has been taken that the matter was re-verified and the Director, S.C.E.R.T., Assam vide her letter dated 21.06.2025 (AnnexureP/OP/F) has recorded that the verification report was not sent from her office.

The learned counsel thus submits that it is not the case of the petitioner that he produced any document before the Vigilance with regard to his teachers training certificate rather it was Vigilance, who verified the document and found it genuine and accordingly it was recorded in the supplementary counter affidavit but in the second supplementary counter affidavit a different stand is being taken. It is asserted and submitted that the two years teachers training certificate of the petitioner is genuine.

5. Learned Special P.P. appearing on behalf of the Vigilance opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Dhankund P.S. Case No.115/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
