JUSTICE ARUN KUMAR ORAL ORDER 06-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with a case registered under Sections 304(B) and 201/34 of the Indian Penal Code.
Allegation in brief is that the petitioner is husband and marriage was solemnized only three years back and it is submitted that she died of illness. It is also submitted that the matter has been compromised.
Considering the fact that the petitioner is husband and his wife's dead body was disposed of secretly and there is nothing to show she was critically ill so I am not inclined to admit the petitioner on anticipatory bail.
Patna High Court Cr.Misc. No.30933 of 2016 (5) dt.06-02-2017 2/2 Accordingly, the prayer for anticipatory bail of the petitioner Prabhu Mahto is rejected in connection with Taraiya P.S. Case No.182 of 2014 pending in the court of Sri Arbind, Judicial Magistrate 1st Class, Saran at Chapra. However, the petitioner may surrender before the court below and seek regular bail, if so advised, so the same shall be considered on its own merit without being prejudiced by this order.
