The petitioner apprehends his arrest in connection with Patarghat P.S. Case No. 222 of 2024 instituted for the offence under Sections 304(2) of the Bharatiya Nyaya Sanhita, 2023.

Prosecution case in short is that while informant was on his way, he was accosted with two miscreants, who snatched his bag containing Rs. One lakh, cheque book, passbook, PAN card etc.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case.
Patna High Court CR. MISC. No.26993 of 2025(2) dt.25-04-2025 2/3 Petitioner is not named in the FIR. Name of the petitioner has surfaced in this on the basis of confessional statement of coaccused, namely, Ravi Kumar and the same has no evidentiary value in the eye of law. No incriminating article has been recovered from the possession of the petitioner. From perusal of the impugned order, it would reveal that co-accused, Raushan Yadav, has snatched the bag of the informant and petitioner was not present at the place of occurrence and he has been enlarged on regular bail by this Court vide order dated 04-03-2025, passed in Cr. Misc. No. 12615 of 2025. Petitioner is a man of clean antecedent.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 6.
Considering the rival submissions made by the learned counsel for the parties, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Patarghat P.S. Case No. 222 of 2024, subject to the conditions as laid
