The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 366A, 120B of the Indian Penal Code.
Accusation is of kidnapping the minor daughter of the informant by Rahul Kumar. The petitioners are the father and brother of Rahul Kumar.
It is submitted by the learned counsel for the petitioners that thrust of accusation is against Rahul Kumar. For the occurrence of 05.09.2015 at 10.00 P.M. the First Information Report was registered on 06.09.2015 at 9.00 A.M. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Considering the thrust of accusation against Rahul
Patna High Court Cr.Misc. No.51068 of 2015 (2) dt.09-11-2015 Kumar, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Judge-III-cum-A.C.J.M.-II, Saharsha in connection with Salkhua P.S. Case No. 191 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
