The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 452, 363, 365, 341, 323, 325, 504, 506/34 of the Indian Penal Code. The prosecution case is that petitioner no.1 Parshuram Singh, his brother petitioner no.2 Ranjay Kumar, Abhinay Kumar

Patna High Court Cr.Misc. No.54382 of 2015 (2) dt.01-12-2015 2/3 and co-accused Ramniwas Singh entered into the house of the informant and started abusing and making assault to the informant, his daughter-in-law, his son and his daughter when other accused persons were standing outside the door, they also entered into the house abused and made assault. It is specifically alleged that the accused persons took away the son of the informant Suraj Kumar but he returned after half an hour and conveyed that he was released since the accused persons had apprehension of being intercepted by the police. It is submitted by learned counsel for the petitioners that petitioner no.1 is father of daughter-in-law of the informant and due to some matrimonial dispute the accusation has been levelled.

Even assuming the accusation no offence under sections 363 and 365 is made out as the son of the informant returned within half an hour of his own and none received any injury. Considering the nature of relationship between the parties and nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Nabinagar P.S.
