The petitioner apprehends his arrest in a case under Sections 406, 420 of the Indian Penal Code and Section 138 of the N.I. Act.

The complainant-informant alleged that the petitioner and four others are the Directors of Adharshila Housing Buildcon Pvt. Ltd. Company. They all came to the informant and asked for loan. The informant gave Rs. 10 lakhs on different dates and in lieu thereof the accused persons issued a cheque in favour of the informant of Rs. 11,23,437/-. It is submitted that the petitioner did not take any loan from the informant nor issued the cheque. The cheque does not bear the signature of the petitioner Md. Shahid Ahmad @ Shahid Ahmad.

Patna High Court Cr.Misc. No.28232 of 2015 (3) dt.09-10-2015 2/2 It appears that the cheque does not bear the signature of the petitioner; rather the cheque was issued by Anup Kumar, Sanjeet Kumar and Sanjay Kumar.

Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Kaji Mohammadpur P.S. Case No. 133/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
