2. The petitioner seeks bail in connection with Kishanganj P.S. Case No. 40 of 2024 instituted for the offences punishable under Sections 419, 420, 467, 468, 471/34 of the Indian Penal Code and Section 10 of the Bihar Conduct of Examination Act.

3. The allegation against the petitioner is that he appeared in the examination of teacher recruitment in place of other candidate.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case.

Patna High Court CR. MISC. No. 28369 of 2024(2) dt.19-04-2024 2/2 Charge-sheet has been submitted in this case. He submitted that the petitioner has selected on the post of teacher and when he went to join on the said post but due to different photo and signature of the petitioner, the authority concern did not accept his joining. Petitioner has not cheated anyone. Petitioner has no any concern with the alleged occurrence and he has been falsely implicated in the present case. The petitioner is in custody since 30.01.2024 and has no criminal antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Kishanganj P.S. Case No. 40 of 2024.
