The petitioner seeks bail in Bakhri P.S. Case No. 208/2018, instituted for offence under Section(s) 395 and 412 of the Indian Penal Code read with Sections 25(1-b)A, 26 and 35 of Arms Act.

It is alleged in the written report that on the date of occurrence informant was coming to his house by motorcycle. At 10:45 P.M. informant reached near Middle School, Simri then five persons threw a piece of bamboo due to which he fell down. Thereafter one accused took out Rs. 1,500/- from his pocket and snatched two ATM Cards, ear rings of gold, mobile and motorcycle of the informant and started running away then the police party, who were on patrolling duty, chased them and

Patna High Court CR. MISC. No.23009 of 2019(2) dt.10-04-2019 2/2 apprehended two of the accused person. It is alleged that one country made Katta and one cartridge were recovered from their possession. Petitioner is said to be one of the accused person who were apprehended by the police.

Learned counsel for the petitioner has submitted that petitioner is in custody since 02.07.2018 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Vth-cum-Sub-Judge IIIrd, Begusarai, in connection with Bakhri P.S. Case No. 208/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
