The petitioners apprehend their arrest in Sabour P.S. Case No. 154/2016, registered for the offences punishable under Section 366A and other sections of the Indian Penal Code. The informant alleged that Ranjan Mandal kidnapped her eldest daughter Kajal Kumari from her house. Learned counsel for the petitioners submits that occurrence is said to have taken place on 02.07.2016, but the complaint petition was filed on 24.08.2016. On the basis of complaint petition present F.I.R. was lodged. The informant did not make any allegation of kidnapping against the petitioners. The petitioners happen to be brother of Ranjan Mandal and that is why
Patna High Court Cr.Misc. No.34848 of 2017 (2) dt.11-08-2017 2/2 they have falsely been implicated in the case. The victim also did not make any allegation against the petitioners. Similarly situated co-accused persons namely, Soni Devi and three others have already been granted anticipatory bail.
Considering the facts aforesaid, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate Xth, Bhagalpur in connection with Sabour P.S. Case No. 154/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
