Petitioner, who is in custody, seek bail in connection with Barhariya P.S. Case No. 32 of 2019 registered for the offence punishable under Sections 272,273,308,34 of the Indian Penal Code and Sections 30(a),41(1) of the Bihar Prohibition and Excise Act,2016.

Learned counsel for the petitioners has submitted that petitioner is not apprehended on the spot. No recovery has been made from conscious possession of petitioner. The name of this petitioner has come in confessional statement of one Manjar Imam from whose possession recovery of illicit liquor has been made. The aforesaid Manjar Imam has already been granted bail by a coordinate Bench of this Court vide order dated 02.04.2019

Patna High Court CR. MISC. No.24433 of 2019(2) dt.16-04-2019 2/2 passed in Cr. Misc.No. 17203 of 2019. Petitioner has no criminal antecedent. He is in custody since 09.03.2019. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl.
