The petitioner is languishing in custody for the offence punishable under Section 395 of the Indian Penal Code. Petitioner and co-accused Chalitar Thakur were identified when they were committing dacoity in the house of the informant.
Learned counsel for the petitioner submits that the petitioner and others had worked in the house of the informant and there was dispute for non-payment of entire wages and just to pressurize the false case has been lodged. Co-accused Chalitar Thakur has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.18904 of 2020. Petitioner is in custody since 28.12.2019.

No.21916 of 2020(4) dt.22-01-2021 2/2 Considering the facts aforesaid and completion of investigation as well as no material to substantiate that the petitioner is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Arer P.S. Case No.134 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
