2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 419, 420, 467, 468, 471, 120B of the Indian Penal Code.
3. Petitioner is alleged to have defalcated Rs. 35,000/- of the informant by opening foreged account in Batsar branch of State Bank of India.
4. It is submitted that petitioner is ready to deposit the total alleged amount of Rs. 35,000/- in the Court below at the time of furnishing bail bond. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.24706 of 2023(3) dt.28-07-2023 2/2 of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Dhoraiya P.S. case no 368 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, in the light of following conditions: 1 . At the time of furnishing bail-bond Rs. 35,000/- shall be deposited through Bank Draft.
2. The aforesaid payment shall be subject to final outcome of the case.
3 . If petitioner fails to comply with the aforesaid direction of this Court, his bail bond is liable to be cancelled. (Prabhat Kumar Singh, J) Kaushik/- U T
