JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30, 30(a), 41 of the Bihar Prohibition & Excise Act, 2016.

According to prosecution case, 113.46 litres Indian made foreign liquor was recovered from a shop and the prosecution claims that the aforesaid shop belongs to the petitioner but submission on behalf of the petitioner is that petitioner does not have any concern with the aforesaid shop and as a matter of fact, petitioner has not been caught on the place of occurrence. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIcum-Special Judge, Siwan in connection with Pachrukhi (Sarai) P.S. Case No. 28 of 2019.
