The petitioner apprehends his arrest in Jai Nagar P.S. Case No. 87 of 2014 registered for the offences punishable under Sections 406, 420, 467, 120B) and 471 of the Indian Penal Code. The informant filed complaint case No. 6626 of 2014 on the basis of which the present F.I.R. was registered. Learned counsel for the petitioner submits that informant named the petitioner Rajesh Kumar in the column of the accused persons but, did not make any sort of allegation against the petitioner. The informant did not disclose about the function of the petitioner in the chit fund company. Birendra Kumar and Subhash Yadav who were the manager and officials of the nonbanking institution have already been granted anticipatory
Patna High Court Cr.Misc. No.30662 of 2017 (3) dt.22-08-2017 bail by this Court vide order dated 05.05.2015 passed in Cr. Misc. Case No. 12158 of 2015 and order dated 28.09.2015 passed in Cr. Misc. No. 39576 of 2015.
Considering the nature of allegation against the petitioner and in the facts that the informant did not make any sort of allegation against the petitioner, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Madhubani in Jai Nagar P.S. Case No. 87 of 2014, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
