JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-10-2020 Heard Mr. Ranjeet Kumar Singh, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Gogari P.S. Case No. 65 of 2020, dated 03.03.2020, instituted for the offence under Section 30(A) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

It appears from the prosecution report that

Patna High Court CR. MISC. No.26436 of 2020(2) dt.21-10-2020 2/2 127.875 litres of liquor has been recovered from a tent house from near the house of the petitioner.

It has been submitted on behalf of the petitioners that neither the motorcycle nor the tent house belongs to him. It has further been submitted that the petitioner is a person of clean antecedents and has wrongly been implemented in this case.

Considering the facts aforestated, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Khagaria in connection with Gogari P.S. Case No. 65 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
