The basic premise of submission of the counsel for the petitioner is that the university has no authority to exercise power under the Bihar Universities Act upon the college, since it is not an affiliated college. The stand is demolished by the materials, which have been brought on record. To that extent, the stand of the petitioner's counsel against the decision of the university cannot be accepted as principle of law.

So far as other grievances are concerned with regard to the managing committee etc., let the petitioner or the managing committee, affected by such issues, approach the university authorities with regard to their grievances, which will be considered

Patna High Court CWJC No.10776 of 2014 dt.04-01-2016 2/2 in accordance with law and appropriate communication will be made on the same within a reasonable time-frame.

Before parting, however, counsel for the university informs the Court that there is a rivalry going on between even the Principals, if not the various claimants under the managing committee.

If that be so, then all such persons may be required to be also heard before a decision on this score can be taken on the representations of the factions or claimants of the college in question.

Writ application stands disposed off with observation / direction as above.
