JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-10-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Hajipur Sadar P.S. Case No. 132 of 2015 registered for the offences punishable under Sections 147, 148, 149, 452, 504, 506, 364, 427, 380, 307, 302, 324 and 326 of the Indian Penal Code. According to the prosecution case, a mob of about 65 persons attacked upon the house of the informant and killed his son Sanjeev Kumar @ Putul. Another son of the informant, namely, Kunkun Patel @ Mantu Patel was also badly assaulted and was admitted into the hospital.

It is contended that though the petitioners are named

Patna High Court Cr.Misc. No.42357 of 2015 (2) dt.09-10-2015 2/2 in the FIR, the deceased had sustained only one injury on his person. The further contention is that the petitioners have been falsely implicated in the present case.

Be that as it may, taking into consideration the serious nature of allegation, I am not inclined to grant pre-arrest bail to the petitioners. Accordingly, the prayer for pre-arrest bail is rejected.
