Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 326, 379, 307, 447, 504, 506 of the Indian Penal Code.
The prosecution case is that the accused persons came at the door of the informant, started abused, in the meanwhile petitioner assaulted with spade on head of informant. It is alleged that co-accused Sonu Giri snatched gold locket from the informant's son. Two cut injuries on the scalp of the informant have been found and opinion has been reserved awaiting the report of C.T. Let the learned court below bring this fact to the notice of Civil Surgeon, Vaishali for the needful. Considering the fact that there is no accusation of repeating the blow and the informant has retracted from his initial version hence, it is a case for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Vaishali P.S. Case No. 206 of 2015, pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur.
With the above observation this application is disposed of.
