JUSTICE SHIVAJI PANDEY ORAL ORDER 29-07-2016 Heard learned counsel for the petitioners and learned counsel for the State.

In this case, petitioners are seeking bail in connection with Jadia P.S. Case No. 21 of 2016 registered for offences under sections 341, 323, 354 (B), 504, 379, 448/34 of the Indian Penal Code.

Allegation has been made in the written application that the lady was misbehaved and was assaulted. It appears from the order of Sessions Judge that the same lady has filed a case against the petitioners which resulted in the compromise. Later on, again a police case has been filed. Plea has been taken that the lady has taken Rs.23,000/- by way of loan and whenever the petitioner goes for demand of the money, she used to file a case.

No.28749 of 2016 (2) dt.29-07-2016 2/2 Looking to facts and circumstances of the case, petitioners, above named, in the event of arrest or surrender before the court below within a period of four weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Kumar Krishna Dev, Judicial Magistrate 1st class, Supaul in connection with Jadia P.S. Case No. 21 of 2016, subject to the condition as laid down under Section 438 (2) Cr. P.C.
