2. The petitioners apprehend their arrest in connection with Bodh Gaya P.S. Case No. 269 of 2023 registered under Sections 341, 323, 448, 354, 379, 307, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. It is alleged that the petitioners along with other coaccused persons assaulted the informant by butt of rifle due to which he sustained head injury. It is also alleged that petitioner no. 1 committed theft of Rs. 5000/- from the pocket of the informant.

4. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. The present case is the counter

Patna High Court CR. MISC. No.29410 of 2024(2) dt.10-05-2024 2/2 blast of SC/ST Gaya P.S. Case No. 14 of 2023 which was lodged by the accused persons against the informant. Further submission is that the petitioners have not committed any offence as alleged in the first information report. The doctor has found the injuries sustained by injured simple in nature. It is lastly submitted that the petitioners have got no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 269 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
