JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 04-08-2016 When the matter was taken up for consideration on 05.05.2015, the learned counsel appearing on behalf of the petitioner had submitted that during the pendency of the writ petition the sole petitioner has passed away and, therefore, on his prayer, the matter was adjourned for six weeks enabling him to file an appropriate petition on behalf of the heirs and legal representatives of the deceased sole petitioner seeking their substitution in the present writ petition vice deceased sole petitioner.
From perusal of the office note dated 27.07.2016 it appears that, despite indulgence granted by this Court by the aforesaid order dated 05.05.2015, no substitution petition has been filed till date.
In above view of the matter, on account of death of
Patna High Court CWJC No.6476 of 2009 (5) dt.04-08-2016 the sole petitioner and on account of the fact that, despite indulgence granted by this Court, his heirs and legal representatives have not come forward to file a petition seeking their substitution in place of original writ petitioner, the present writ petition has abated.
Consequently, the present writ petition, as a whole, is dismissed.
