JUSTICE MUNGESHWAR SAHOO ORAL ORDER 06-01-2016 Mr. Naresh Chandra Verma, learned counsel appearing for the petitioner submitted that, in fact, the order, whereby the court below has rejected the revocation application, is appealable under Section 299 of the Indian Succession Act, therefore, he may be permitted to convert this writ application, under Article 227 of the Constitution of India, to Miscellaneous Appeal, under Section 299 of the of Indian Succession Act.
In view of the submission, the petitioner is permitted to convert this writ application, under Article 227 of the Constitution of India, to Miscellaneous Appeal, under Section 299 of the Indian Succession Act. The petitioner shall convert the same within three weeks' positively, failing which, this writ application shall stand dismissed as not maintainable.
