The petitioners apprehend their arrest in a case registered for offences punishable under Sections 304 B and 34 of the Indian Penal Code and Section 3⁄4 of D.P. Act. Petitioner nos.1 to 3 are brother-in-law of the deceased whereas petitioner no.4 is admittedly a neighbor. It is contended that neighbor cannot demand dowry or torture the victim. It is contended that parents-in-laws, cousin father-in-law and mother-in-law have already been granted regular bail. So far the petitioner nos.1 to 3 are concerned, they are brother-in-law and

Having regard to the facts and circumstances of the case, let the petitioners, namely, Vikky Kumar @ Vikky Kumar Sahani, Bade Lal Sahani @ Bade Kumar Sahani, Chhote Lal Sahani @ Chhote Kumar Sahani and Birju Kumar Sahani be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Saraiya P.S. Case No.328 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of S.D.J.M. (West), Muzaffarpur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
