ANJANA MISHRA ORAL ORDER 16-08-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Ariyari P.S. Case No.129 of 2014 for allegedly having committed the offence under Sections 419, 420 and 406 of the Indian Penal Code.

The only allegation against the petitioner is that he had made the informant an agent of Non-Banking Company, but since the Company was unable to return the money due to non-availability of liquid fund, the petitioner's name has been brought in connection with the present case.

It is submitted by the petitioner that the Company is ready to offer the land in lieu of money, which they had taken

Patna High Court Cr.Misc. No.35674 of 2017 (2) dt.16-08-2017 2/3 from the respective investors. Thus, there is no intention of the petitioner to cheat the customers. It is further contended by the petitioner that other similarly situated co-accused/agents have been extended the privilege of anticipatory bail in Cr.Misc. No.31548 of 2016, vide order dated 30.08.2016. Considering the nature of allegations made and that other similarly situated co-accused have been extended the privilege of anticipatory bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sheikhpura, in connection with Ariyari P.S. Case No.129 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
