Learned counsel for the petitioner submits that petitioner deposited earnest money amounting to Rs.6500/- on 10.08.1990. The petitioner was allotted flat at Bahadurpur, Patna bearing Flat No.3 MF-10/2 under the Middle Income Group. After allotment the petitioner has requested to change flat from Bahadurpur, Patna to Hanuman Nagar, Patna and sanction of transfer was accorded on 05.02.2009. Learned counsel for the petitioner submits that the
Patna High Court CWJC No.7833 of 2019(2) dt.15-04-2019 2/2 petitioner is at the verge of retirement but file as to allotment is still hanging is balance.
It is submitted on behalf of petitioner that the matter is old, the Court may direct the Housing Board to take appropriate decision at the earliest so that at the evening of his life he may enjoy the benefit of allotment of flat. Considering the aforesaid, the present writ application stands disposed of with a direction to the Housing Board to take appropriate decision with regard to registration of the flat on payment of the prescribed rate within a maximum period of four months from the date of receipt/production of a copy of this order. The Housing Board is expected to settle the rate within the aforesaid time so that the petitioner may enjoy the benefit of allotment of flat under the Scheme of Bihar State Housing Board after payment of price of flat and registration. With the aforesaid, the present writ application stands disposed of.
