JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-11-2020 This writ application has been filed for quashing letter No. CBSE/RO/PTN/M&M/INC-148/19/2020 dated 21.01.2020 as also letter dated 07.08.2019 as contained in Annexure-6 to the writ application issued by the Central Board of Secondary Education (CBSE), Regional Office, Patna, whereby the petitioner's application for correction of his father's name and mother's name in the documents/certificates of All India Secondary School Examination, 2019 has been rejected on the ground that the desired corrections do not match the school records.

Patna High Court CWJC No.7354 of 2020(5) dt.10-11-2020 2/3 Mr. Sanjay Kumar Ghosarvey, learned counsel appearing on behalf of the petitioner, has submitted, on instructions, that he is not pressing the relief for correction in mother's name in the said certificate/documents. A counter affidavit has been filed on behalf of the CBSE, wherein it has been stated as under : - "That the present writ application was heard on 14.09.2020 and the respondents were directed to file countr affidavit. The Hon'ble Court further finding the desired correction to be minor in nature and also on the fact that letter "L" has been written as "R" directed to make necessary changes in father's name. Steps have been initiated to make the necessary correction in father's name and accordingly correction in father's name has been approved from "BIPUR BARIYAR' to 'BIPUL BARIAR' and the same has been informed to the School concerned vide this office letter No. CBSE/RO/PTN/M&M/INC-148/19/2020 dated 29.09.2020."

It is evident from the aforesaid statement in paragraph 10 that the CBSE has taken steps for necessary correction in father's name, as sought for by the petitioner, and such correction has been approved.

Mr. Vinay Krishna Tripathy, learned counsel representing the CBSE, has submitted that the petitioner is required to fulfill certain formalities for issuance of fresh original certificate after correction in the father's name, i.e.,

Patna High Court CWJC No.7354 of 2020(5) dt.10-11-2020 3/3 submission of the original certificates, which have been issued to the petitioner.

Learned counsel appearing on behalf of the petitioner has submitted that such formalities have been completed and original documents have been submitted to the school. In view of the above, this application is disposed of with an observation that let CBSE, Regional Office, Patna, ensure issuance of fresh original certificate and marks-sheet within one month from the date the documents are received from the school where the petitioner is pursuing her studies.
