JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner, counsel appearing on behalf of the State.
The petitioner apprehend their arrest in connection with Goh P.S. Case No.31 of 2017 registered under Sections 147, 149, 342, 353, 188 of the Indian Penal Code and 7/9 of Bihar Control of the use and Play of Loudspeaker Act, 1955. The learned counsel for the petitioner submitted that the petitioners have no other criminal antecedent except Uphara P.S. Case No.08 of 2017 dated 22.02.2017. Allegation against the petitioners is that petitioners were involved in raising slogan in the protest. The police had lodged FIR against 38 persons including
Patna High Court Cr.Misc. No.13679 of 2018 (2) dt.05-04-2018 2/2 these present petitioners for such protest.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Goh P.S. Case No.31 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
