The petitioners seek anticipatory bail in Biraul P.S. Case No.416 of 2016, corresponding to G.R No. 952 of 2016 instituted for the offences under Sections 147, 148, 341, 323, 338, 380, 307, 427, 504 and 506 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.. As per First Information report the victim has constructed the house under Indira Awash Yojna. In the fateful night accused persons forcibly entered into the house, assaulted the victim, taking him out from the house and tied him in the tree. In such view of the matter, this Court is not inclined to enlarge the petitioners on anticipatory bail. Accordingly the prayer for bail is rejected.
