This application for grant of anticipatory bail arises out of Halsi P.S. Case No. 84 of 2014, disclosing offences under Sections 409 and 420 of the Indian Penal Code. The petitioner is a lady and nominated Secretary of Upgraded Middle School, Gulani in the district of Lakhisarai. The allegation relates to misappropriation of public fund released for the purpose of construction of certain rooms of the School. It is submitted on behalf of the petitioner that the said amount was withdrawn by the Headmaster of the School namely, Ranjeet Ravidas.
Learned counsel for the petitioner submits that the Headmaster of the School,who has been named in the First
Patna High Court Cr.Misc. No.58159 of 2015 (2) dt.30-01-2016 2/2 Information Report, has been granted the privilege of anticipatory bail by this Court by order dated 13.05.2015 passed in Criminal Miscellaneous No. 2059 of 2015.
Considering the submission that petitioner is a lady and co-accused Ranjeet Ravidas has been granted anticipatory bail by this Court, this application is allowed.
Let the petitioner, above-named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Halsi P.S. Case No. 84 of 2014, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
