It has been reported that in reference to letter received by FAX No. 47922 dated 22.08.2015 in connection with Cr.Appeal(SJ) No. 931 of 2011, that Officer-in-Charge, Naubatpur P.S. was directed to give report regarding the accused Gopal Prasad, Son of Ram Chandra Prasad, Resident of Village+P.S. Naubatpur, District-Patna, in connection with the status as to whether he is live or dead.

In compliance of the order, Officer-in-Charge, Naubatpur P.S. has reported that after due enquiry it was found that accused Gopal Prasad died on 31.01.2012 and in this connection death certificate of Gopal Prasad was made available to the Officer-inCharge and from perusal of the report it appears that death

Patna High Court CR. APP (SJ) No.931 of 2011 (5) dt.17-09-2015 certificate has been issued by Patna Municipal Corporation, Patna, and the same has been attached.

Having regard to the fact since the appellant, Gopal Prasad has been died as he is sole appellant in this Cr. Appeal (SJ) 931 of 2011. Accordingly, the appeal is abated and disposed of. m.p.
