Heard Mr. Suneil Kumar Thakur, learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.

The application for grant of bail to the petitioner, above named, who has been made accused and put behind the bar in connection with Teghra P. S. Case No. 337 of 2020 registered for the offences punishable under Sections 302, 201, 120(B) read with 34 of the Indian Penal Code. As per the prosecution case, it is alleged that the husband of the informant was abducted from Goshala complex by unknown persons. It is further alleged that on the next morning, the co-accused Amresh Chourasia called the informant

Patna High Court CR. MISC. No.24708 of 2022(2) dt.10-08-2022 2/3 and confessed his guild that he has committed the murder of her husband and thrown his dead body.

Learned counsel appearing on behalf of the petitioner submitted that the petitioner is not named in the F.I.R., however, his name has transpired on the confessional statement of Amresh Chourasia and moreover, other co-accused persons whose names also transpired on the confessional statement of Amresh Chourasia, have already been granted bail by different co-ordinate Benches of this Hon'ble Court. Copies of which have been annexed as annexure 2 & 2/1 to this application. It is next submitted that there is no eye-witness to the alleged occurrence and moreover, this petitioner is in custody since 10.01.2022, having fair antecedent. On the other hand, learned APP for the State opposes the bail application and submits that the name of the petitioner has transpired during the course of investigation.

No.24708 of 2022(2) dt.10-08-2022 3/3 identical allegation have already been granted bail by this Hon'ble Court, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Teghra P. S. Case No. 337 of 2020, subject to the condition that one of the bailors will be the close relative of the petitioner with further conditions which are as follows:- (i) The petitioner will cooperate in conclusion of the trial.

(ii) He will remain present on each and every date of trial till disposal of the case.

(iii) He will not try to tamper with the evidence or intimidate the witnesses to delay the disposal of trial.

(iv) In the event of default of two consecutive dates without any cogent reason, his bail bonds will liable to be cancelled.
