JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 24-07-2025 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State duly assisted by learned counsel for the informant.

2.The accused/petitioners seek bail in connection with Kasim Bazar P.S. Case No.300 of 2024 registered for the offences punishable under Sections 80, 61 and 3(5) of the Bhartiya Nyay Sanhita, 2023.

3.The accused/petitioners are named in the FIR and are in custody since 21.10.2024.

4. Allegation against the petitioners is to

Patna High Court CR. MISC. No.24861 of 2025(3) dt.24-07-2025 2/3 cause death of daughter of the informant along with other named accused persons/family members due to non-fulfilment of demand of dowry as raised for Rs. 4-5 lacs.

5. It is submitted by learned counsel appearing for petitioners that petitioners are inlaws and they have no connection with daily and domestic affairs with the deceased and her husband. It is submitted that deceased has died out of accident, as she received injuries on the same body part where she was operated during delivery, before three months of the occurrence, and subsequently, out of oblique motive, the petitioners being in-laws were implicated falsely. It is submitted that investigation of this case is already completed, for which, charge-sheet has been submitted and, as such, there is no chances of tampering with the evidence.

6. Learned APP duly assisted by Mr. Rajesh Kumar Sharma, learned counsel appearing for the informant while opposing the prayer for bail submitted that petitioners being in-laws actively

In view of aforesaid facts and circumstances and by taking note of fact as both above-named petitioners are in-laws prima facie having no connection with daily and domestic affairs with deceased, where both the petitioners are in custody since 21.10.2024, accordingly, both, above-named, petitioners are directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Munger in connection with Sessions Trial No.88 of 2025, arising out of Kasim Bazar P.S. Case No.300 of 2024, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure (for short 'CrPC')/under Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita (for short 'BNSS').
