The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 353, 307, 332, 333, 337, 338, 427, 379, 411, 420, 120(B) and 504 of the Indian Penal Code.

The informant alleges that he along with police force seized a tractor laden with sand and when the tractor was being taken to the police station, accused persons intercepted and tried to free the tractor and even pelted stones causing injury to three constables and on arrival of the police force, they fled and the accused were identified by the local chowkidar. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely

No.25347 of 2022(2) dt.23-08-2022 2/2 implicated in the present case, petitioner is the owner of the tractor and as such was not knowing what the driver was doing when he had taken the tractor from home, it is next submitted that petitioner has already deposited Rs. 31,923/- in favor of the Mining Department with respect to the loss caused on account of carrying of the sand.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Giriyak P.S. Case No. 103 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
