For the Petitioner/s : Mr. Ravindra kumar, Adv. For the CBSE : Mr. V.K. Tripathi, Adv. For the UOI : Mr. Arvind Kumar Tewary, CGC =========================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT & ORDER Date: 09-10-2017 The petitioners are full brothers and are sons of
Patna High Court CWJC No.9151 of 2017 dt.09-10-2017 2/3 'Harendra Choubey'. They have passed Secondary (Xth Std.) Board Examination, held by the Central Board of Secondary Education (in short 'CBSE'), in the year 2011. In the Xth certificates, issued by the CBSE, their father's name has been mentioned as 'H. Choubey'.
2. This application has been filed, under Article 226 of the Constitution of India, seeking direction to the CBSE to make necessary correction in the certificates of the petitioners, issued by the CBSE, by mentioning 'Harendra Choubey', in place of 'H. Choubey', as the name of the father of the petitioners.
3. On perusal of the records, it appears that even in the school records, where the petitioners had studied, their father's name had been entered as 'Harendra Choubey'.
4. It is submitted on behalf of the petitioners that the petitioners are being made to suffer because of such entry made in their certificates, so far it relates to their father's name.
5. A counter affidavit has been filed on behalf of the CBSE, stating therein that the claims of the petitioners for necessary correction in their certificates have been rejected, such claims being time barred. It appears that an application for correction in the certificates, under the examination Bye-laws, has to be made within a period of one year from the date of issuance of
Patna High Court CWJC No.9151 of 2017 dt.09-10-2017 3/3 the certificate.
6. However, considering the facts and circumstances and in the interest of justice, I dispose of this application with a direction to the CBSE to substitute 'Harendra Choubey', in place of 'H. Choubey', as the name of the father of these petitioners in their Xth certificates, issued by CBSE, within a period of six (6) weeks from the date of receipt/production of copy of this order.
8. This application stands disposed of accordingly. (Chakradhari Sharan Singh, J) Praveen-II/- AFR/NAFR NAFR CAV DATE N/A Uploading Date 10.10.2017 Transmission Date N/A
