In view of the statement made in paragraph 6 of the writ petition as well as paragraph 9 of the counter affidavit filed on behalf of respondent nos. 2, 3 and 4, this writ application is being disposed of with a direction to the District Magistrate, Khagaria to consider the representation filed by the petitioner as an appeal and take a decision within a period of two months from the date of receipt/production of a copy of this order. If the appeal is required in proper format then the petitioner may be directed by him to submit a memorandum of appeal in proper proforma as it is well-established that the technicalities should not come in way doing full justice.
